1. Application and booking

These terms apply to the marine inspection services supplied by the Provider (we, us or our) to the customer named in the booking (you or your).

Your agreement comprises these terms, the service description displayed or supplied before purchase, your accepted quotation or checkout order, and any subsequent changes agreed in writing. The common inspection scope and exclusions are set out in this document; no separate inclusions schedule is required. A specifically agreed written variation prevails over an inconsistent general provision. Nothing in these documents overrides a right that cannot lawfully be excluded.

By accepting these terms at checkout or approving a quotation that includes them, you engage us for the selected service. We will acknowledge your order and confirm scheduling arrangements separately. A requested inspection date is not confirmed until we confirm it in writing. If we cannot fulfil your order, we will promptly notify you and refund payment for services not supplied.

We will not change the agreed price, scope or terms of an existing booking without your agreement, except where the law requires a change. Website price changes apply to future bookings only.

2. Common inspection scope and purpose

2.1 Services covered. These terms apply to our pre-purchase marine inspections, general vessel condition inspections, condition reports for insurance purposes, sea trials and optional trailer inspections or specialist tests. A different service name, package price or vessel size does not, by itself, change the common scope below. An inspection sold as a full-vessel pre-purchase, general condition or insurance condition inspection includes the common visual assessment in clause 2.2 and written report in clause 8. Optional services are included only where expressly purchased or agreed in writing.

If you purchase a standalone sea trial, trailer inspection or specialist test, the scope is the relevant service described in these terms; it does not include a full-vessel inspection unless that is also purchased. Any agreed restriction to a particular component or area must be clearly disclosed and accepted before purchase; it cannot be imposed for the first time in the report.

2.2 Common visual assessment. For a full-vessel inspection, we will examine the following items where fitted, reasonably accessible and capable of being examined safely without dismantling. The assessment concerns apparent condition, visible defects and observable signs of deterioration; it is subject to the exclusions in clause 13.

Area Common visual assessment
Hull and structure Accessible external hull surfaces, deck, transom, visible internal structural areas, and visible signs of damage, cracking, distortion, corrosion, leakage or previous repair. Underwater surfaces are assessed only where made safely accessible as explained in clause 3.
Machinery and propulsion Accessible engine and drive components, mountings, belts, hoses, visible fluid leaks, cooling and exhaust connections, and visible propellers or running gear where safely accessible. Internal mechanical condition and operation under load are outside this visual assessment.
Electrical installation Accessible batteries, restraints, terminals, wiring, connections and visible signs of corrosion, overheating, damage or insecure installation. This is not electrical certification or a concealed-wiring assessment.
Fuel, plumbing and bilge Accessible tanks, lines, hoses, connections, valves, seacocks and bilge areas, including visible leakage, deterioration and apparent installation concerns. Sealed or concealed components are not opened.
Deck fittings and interior Accessible rails, cleats, hatches, doors, windows, visible cabin surfaces and accessible fittings, including visible damage, insecurity and signs of water entry. This does not involve removing furniture, upholstery or fixed linings.
Safety equipment Presence, apparent physical condition, accessibility and visible expiry or service dates of equipment made available for inspection. We will report apparent safety concerns, but this is not certification that all legally required equipment is carried, suitable, serviced or operational.

2.3 Functional checks.
The common assessment includes simple, non-invasive operational checks of accessible navigation lights, horn, wipers, bilge-pump controls and installed instruments where fitted, authorised, safe and supported by available power and suitable operating conditions. Instrument checks establish apparent response or power-up only, not accuracy or calibration. Pumps will not be run dry, and we will not discharge equipment or operate safety-critical equipment in a way that could cause harm. Equipment is not treated as tested merely because a switch responds.

Engine starting or running, operation of transmissions or propulsion, sea trials, compression or leak-down testing, diagnostic scanning, moisture testing, thickness measurement and laboratory analysis are additional services unless expressly included in the purchase or agreed in writing. Sea-trial observations are governed by clause 5. Functional checks do not establish future reliability or performance in conditions not encountered.

2.4 Purpose and reasonable limitations. We will perform the agreed services with due care and skill, within the agreed timeframe or, if none is agreed, within a reasonable time. Tell us before booking about particular concerns, purchase deadlines and insurer or lender requirements. We will confirm whether our service can meet them. If the standard scope is unsuitable for a purpose you make known to us, we will explain this before proceeding and agree an appropriate alternative or decline the booking.

We will not accept work requiring qualifications, accreditation or authorisation we do not hold. We will record what was examined and tested and any material restrictions. An item not examined or tested will be identified as such; it will not be represented as satisfactory simply because it could not be assessed. If a restriction materially affects the agreed purpose, clause 3 applies. Inspection time limits or access difficulties do not give us an unrestricted right to omit agreed work.

2.5 Nature of the service. This is a condition assessment at a particular time, not an exhaustive examination of every component, a warranty of the vessel, an assurance of remaining service life or a guarantee against future failure. It does not certify suitability for every voyage, load, sea state or operating condition.

A condition report or document described as a seaworthiness assessment is not an AMSA certificate of survey, statutory approval, registration inspection or other regulatory certification. Regulatory certification is excluded unless separately agreed and performed by appropriately authorised persons. An insurer or lender decides whether a report meets its requirements; we do not guarantee acceptance. This does not reduce our obligations to provide a service we have agreed will meet a particular requirement, or any obligation imposed by law.

3. Access, permission and preparation

You must provide accurate vessel details, its location and relevant information known to you about defects, damage, modifications, hazards and operating restrictions. If you are not the owner, arrange the owner's permission for the agreed inspection, photographs and tests. We may require written permission before proceeding.

We will explain preparation and access requirements in advance. You must arrange agreed keys, access, marina permissions, power, water, safe machinery access and any required haul-out or vessel operator. Please do not arrange chargeable third-party services until the inspection requirements and timing have been confirmed.

External underwater hull areas can be inspected only where the agreed service provides safe access, such as on an appropriate trailer or hardstand. An afloat inspection does not include inaccessible underwater areas unless a specific underwater inspection is agreed.

We will identify material access restrictions, tests not completed and their implications in the report. If an unexpected restriction substantially compromises the agreed purpose, we will contact you to discuss postponement, a revised scope or cancellation. We will not substitute a materially reduced service without your agreement.

4. Testing and component removal

Opening ordinary service hatches and accessible covers is included where reasonably necessary and safe. Dismantling, removing fixed components, invasive testing, specialist diagnostics and repairs are excluded unless expressly agreed with the customer and authorised by the owner.

Functional checks are limited to clause 2.3 unless additional testing is expressly purchased or agreed in writing. Engine running, compression testing and other additional tests will be performed only if agreed, safe and suitable for the engine or equipment concerned. Compression testing may require accessible spark plugs, glow plugs or injectors, specialist equipment and separate authority. We will explain any additional work, risk and cost before seeking approval.

We may decline or stop a test where there is a reasonable safety concern or risk of damage. We will explain the reason and record any resulting limitation. Authorising a test does not release us from responsibility for failing to exercise due care and skill.

5. Sea trials

A sea trial is included only if expressly booked. Its agreed purpose is to observe specified systems and vessel behaviour under the conditions encountered; it is not an endurance test or confirmation of suitability for every operating condition.

Before a trial, we will confirm who will be the master or skipper, who will operate the vessel, the intended scope, passenger arrangements and any necessary permissions. By default, the owner or their authorised, appropriately licensed and competent operator retains navigational command and control. Our attendance as inspector does not make us the vessel operator. If we are to supply the operator, this must be separately agreed in writing and supported by the qualifications, permissions and insurance required for that activity.

The trial will proceed only where the vessel, operator, weather, loading, safety equipment and other arrangements are reasonably suitable and the operation is lawful. The owner or operator must provide adequate fuel, required safety equipment and relevant vessel documentation. We may request evidence of appropriate vessel insurance. Any commercial-vessel requirements, exemptions or approvals must be resolved before departure where applicable.

The master retains responsibility for navigation and operational safety. Each participant must follow reasonable safety directions. We may decline to participate or request that testing cease if conditions are unsafe. Nothing in this clause transfers our own legal obligations or excludes liability for our negligence.

A preliminary inspection or decision to proceed does not certify that a vessel is free from defects. We will record trial conditions, material limitations and the checks performed.

6. Fees and additional costs

The agreed price, applicable GST, payment timing and known travel or access charges will be disclosed before purchase. Optional services, trailer inspections, sea trials, laboratory testing and specialist assessments are charged only if included or subsequently approved.

We will obtain your approval before incurring additional charges. Unless included in our price, approved marina, haul-out, launch, hardstand and other third-party charges are payable as agreed with the relevant provider. We do not have authority to approve unlimited third-party costs on your behalf.

7. Cancellation, rescheduling and interrupted work

Contact us promptly if you need to change or cancel a booking. We will take reasonable steps to accommodate rescheduling and minimise avoidable costs.

If you cancel for a reason other than exercising a statutory right, we may deduct a reasonable amount for work properly performed and reasonable, evidenced, unrecoverable costs directly resulting from the cancellation. Any cancellation charge or basis for calculating it must have been clearly disclosed before booking. We will take reasonable steps to minimise our loss, account for costs saved and replacement bookings, avoid double recovery, and provide an itemised explanation. There is no automatic percentage cancellation penalty under these terms.

If access is refused, the owner does not authorise the work, or agreed essential preparations are missing, we will contact you where practicable before leaving the site. Any charge for the resulting interruption is subject to the same requirements above. A return visit requires agreement on its scope and price.

If weather or another circumstance beyond either party's reasonable control prevents safe performance, we will discuss rescheduling. If no reasonable alternative can be agreed, either party may cancel the affected service. We will refund the unperformed portion; any deduction for completed work or approved non-recoverable third-party costs must be reasonable, lawful and explained. We will not charge a cancellation penalty for unsafe weather.

If we cancel because we cannot provide the agreed service, we will refund payment for the services not provided. If a partly completed service has no reasonable value for the agreed purpose, we will take that into account in determining the refund. This does not limit any further remedy available by law.

Refunds will be made promptly through the original payment method unless otherwise agreed. This clause does not restrict rights arising from misleading conduct, a failure to meet a consumer guarantee or any other applicable law.

8. Reports and recommendations

We will email your report within the timeframe agreed for your booking. We will notify you of any anticipated delay and discuss its implications, particularly where we know of a purchase deadline.

The report describes observations and test results at the inspection date, not a promise about future condition. Findings must be read together with the agreed scope, access restrictions and recommendations. We will distinguish observations from opinions and identify where further specialist investigation is recommended. A report marking an item as satisfactory means only that no reportable concern was identified within the examination or test performed; it does not certify that the item is free of concealed defects. We will state material limitations rather than issue an unqualified assessment of an unexamined item.

Hidden, inaccessible or intermittent defects may not be discoverable within the agreed scope. However, these limitations do not excuse a failure to identify or report matters that a competent inspector exercising due care and skill should have identified within that scope.

Before purchase or use, consider any recommended repairs or further investigations. Do not operate equipment identified as unsafe until it has been appropriately assessed and rectified. Decisions about purchase, repairs and operation remain yours or the owner's, without reducing our responsibility for our own service.

Unless expressly included, we do not verify title, finance, liens, recall completion, service-history authenticity, market value or compliance with every applicable standard. Ask us before booking if you require any of these checks.

9. Sharing and reliance

The report is prepared for the customer and the agreed purpose. We retain copyright and grant you a continuing right to use, copy and share the complete report for that purpose, including with your insurer, lender, seller and professional advisers.

Do not alter findings or present extracts in a misleading way. Sharing does not of itself extend our engagement to another person or purpose. Anyone wishing to rely on the report for a separate transaction or purpose should contact us to agree whether further inspection or written permission is needed. This clause does not exclude any duty or liability imposed by law.

10. Loss, damage and consumer rights

Nothing in this agreement excludes, restricts or modifies any consumer guarantee, remedy or other right that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation. Where such a right applies, it prevails over any inconsistent term.

Our liability for loss, damage or injury is determined under applicable law, including responsibility for failure to exercise due care and skill. No provision of these terms releases us from responsibility for our negligence or requires you to indemnify us for loss caused by us. These terms do not set a contractual dollar limit on our liability.

An inspection is not insurance for the vessel or trailer. Owners should maintain appropriate insurance for their property and its operation, transport, slipping and storage. This recommendation does not transfer our legal responsibility to the owner or their insurer.

11. Personal information and photographs

We collect and use customer details, vessel information and inspection photographs to arrange and perform the service, prepare reports, maintain appropriate records and meet legal obligations. We may disclose relevant information to service providers or others where reasonably necessary for these purposes and permitted by law.

Our Privacy Policy at [privacy policy link] explains our information-handling practices and how to raise privacy enquiries. Marketing consent is separate from accepting these terms. We will seek separate permission before using identifiable customer or vessel photographs in advertising.

12. Complaints and applicable law

Contact [complaints email] or [telephone] with your booking details and concern. We will acknowledge your complaint within five business days and seek to resolve it promptly, keeping you informed if further investigation is required.

Please give us a reasonable opportunity to investigate, where practicable. You do not need to delay urgent safety action, and this process does not limit your right to seek legal advice, contact a regulator or consumer protection agency, or use a court or tribunal.

Australian law applies, including applicable state or territory law and the Australian Consumer Law. No term requires you to bring a claim in a place that removes a mandatory legal protection. If a provision is invalid or unenforceable, the remaining provisions continue to the extent they can lawfully operate.

13. Common exclusions and additional-service boundaries

These exclusions form part of the common scope for every service under these terms. They do not exclude an assessment or test expressly promised in the service description or subsequently agreed in writing. Additional work can be agreed in a quotation, checkout order or email; no separate schedule is required. A broader description expressly promised before purchase cannot be withdrawn by a conflicting general exclusion.

13.1 Concealed and inaccessible defects. Unless additional testing is agreed, we do not determine the condition of concealed laminates, cores, stringers, frames, internal transom structure, keel bolts, internal engine or transmission parts, concealed wiring, sealed tanks, internal pipework or other parts that cannot reasonably be examined without dismantling or specialist testing. We will nevertheless report visible warning signs within the common inspection scope and recommend further investigation where reasonably indicated. Damage cannot be excluded merely by calling its cause hidden if observable signs should reasonably have prompted a finding or recommendation.

13.2 Specialist measurements and diagnostics. Unless expressly agreed, there is no hull thickness or moisture measurement, structural calculation, compression or leak-down test, diagnostic scan, borescope inspection, fluid laboratory analysis, electrical insulation test, battery load or capacity test, pressure test, gas test, corrosion-potential or stray-current measurement, instrument calibration, or formal performance measurement. We do not verify engine power, fuel consumption, emissions, hour-meter accuracy, propeller balance, pump flow rate or equipment efficiency beyond the checks actually agreed and performed.

13.3 Rigging and elevated areas. Unless expressly agreed, there is no mast climbing, aloft inspection, rigging tension or load testing, dismantling of rigging terminals, or assessment of concealed deterioration in masts, sails, standing or running rigging. Accessible visible fittings remain subject to the common visual assessment where relevant.

13.4 Safety and compliance certification. Visual safety-equipment checks do not include activation, discharge, servicing, load testing or certification of lifejackets, flares, extinguishers, distress beacons, liferafts or anchor systems. We do not certify the vessel's compliance with every applicable equipment, design, electrical, gas, registration, commercial-operation or other legal requirement. If expressly engaged for a particular compliance assessment, that agreed assessment remains included and must be within our authorisation and competence.

13.5 Trailers. Trailer inspection is additional unless expressly purchased. Where purchased, it comprises visual examination of accessible frame and drawbar, coupling, safety chains, winch and visible strap or cable, rollers or bunks, tyres, wheels, visible brake components and accessible lights, together with a simple lighting check where a suitable connection is available. It does not include removing hubs, dismantling brakes or bearings, road testing, brake-efficiency testing, alignment measurement, structural engineering assessment, roadworthiness certification, weighing or load-distribution calculations unless expressly agreed. Any equipment or weighing limits will be disclosed before booking.

13.6 Legal, documentary and historical matters. Unless expressly agreed, we do not establish ownership, title, finance or security interests, registration validity, recall completion, market value, authenticity of records or whether earlier repairs and servicing met their original specifications. We may review documents made available as background, without treating unverified statements as independently established facts. We do not predict future failures, costs or remaining component life with certainty.

13.7 Intermittent faults and changed conditions. An inspection may not reveal faults that occur only after prolonged use or under conditions not reproduced. Findings do not extend to later deterioration, modification, damage or changed operating conditions. This does not exclude responsibility for a defect or warning sign that should reasonably have been identified within the agreed scope at the inspection date.

13.8 Repairs and follow-up. The inspection does not include repairs, adjustment, maintenance, supervision of repairs or verification that recommendations have been completed. A return inspection or repair verification must be separately agreed. We will not describe remedial work as verified without an appropriate agreed assessment.

13.9 No retrospective reduction of scope. Material exclusions must be available before purchase. Report qualifications record actual conditions and limitations; they do not retrospectively remove agreed work or excuse a failure to exercise due care and skill. These exclusions are subject to clause 10 and all non-excludable legal rights.
